ABA files brief urging Supreme Court to review case that the ABA contends threatens the attorney work product doctrine
The ABA Journal is reporting that the ABA has filed a brief urging the U.S. Supreme Court to review a decision favoring the Federal Trade Commission in its battle to obtain attorney documents regarding a drug company’s settlement agreement with a generic manufacturer, arguing that the appellate decision “opens the floodgates” to disclosure of attorney work product in government investigations.
