Speaking of frivolous litigation, how about frivolous legislation?

Prof. Jonathan Turley is reporting today (here) that the governor of Utah has signed legislation authorizing the state to exercise eminent domain over federal lands. Clearly a state has no authority to do this but it has not stopped the state from setting aside $3 million dollars to litigate to defend it. This clearly would be frivolous litigation.
